The Prison Rape Elimination Act (PREA)

The Hampden County Sheriff's Department and Correctional Center makes known to all employees, vendors, contractors, volunteers, interns, service providers and consultants that it will fully enforce the Prison Rape Elimination Act (PREA). The Prison Rape Elimination Act (PREA) is a Federal Law which passed unanimously by the U.S. Congress and signed into law in 2003. The Act supports the elimination, reduction, and prevention of sexual harassment, sexual misconduct, sexual assaults and rape in all correctional systems including federal, state, county, and other law enforcement detention facilities.

The Hampden County Sheriff's Department and Correctional Center has a zero tolerance policy for such offense and each case will be thoroughly investigated. Once you are made aware of any of these incidents taking place you are to report this immediately to staff for investigation. The Hampden Sheriff's Department views all sexual contact between inmates/detainees or between inmates/detainees and employees, volunteers, interns, service providers, consultants, vendors and contractors coercive and NEVER consensual.

The Hampden County Sheriff's Department and Correctional Center makes known to all employees, vendors, contractors, volunteers, interns, service providers and consultants that it will enforce Massachusetts General Laws Chapter 268, Section 183, which reads as following:

Section 21A. An officer or other person who is employed by or contracts with any penal or correctional institution in the Commonwealth, and who, in the course of such employment or contract or as a result thereof, engages in sexual relations with an inmate confined therein, within or outside of such institution, or an inmate who is otherwise under the direct custodial supervision and control of such officer or other person, shall be punished by imprisonment for not more than five years in a state prison or by a fine of $10,000 or both. In a prosecution commenced under this section, an inmate shall be deemed incapable of consent to sexual relations with such person. For purposes of this section, sexual relations shall include intentional, inappropriate contact of a sexual nature, including but not limited to conduct prohibited by Section 22 or 24 of Chapter 265 or Section 2, 3, 35 or 53A of Chapter 272. As part of PREA, the Department is mandated to run a CORI check every two (2) years as a part of your continued services.

Criminal Offender Record Information (CORI)

Criminal Offender Record Information (CORI) is data compiled by a criminal justice agency concerning an identifiable individual and which relates to the natures of an arrest, criminal charge, judical proceeding, incarceration, rehabilitation or release, and may include a juvenile tried as an adult.

Volunteers, vendors, interns and contractors shall abide by all CORI regulations and shall not divulge any confidential information about inmates to anyone other than that which is necessary for the performance of that employee's duties.

Under 803 CMR, only those officials and employees of criminal justice agencies, as determined by the administrative heads of such agencies, shall have access to CORI. Criminal justice employees are eligible to receive CORI as needed during the course of their official duties.

Be advised even though certain information may be available through the media about individuals who may be in your caseload of work, it is not permissible to discuss information with anyone outside of the scope of your assignment. Volunteers, vendors, interns and contractors are never allowed to divulge information obtained at the Correctional Facility including, but not limited to: security procedures, inmate information and employee information.

CORI must be maintained in accordance with MGL Chapter 6, Section 167/179. Willful, unauthorized dissemination of CORI may subject the offending agency or individual to a find of $5,000.00 and/or up to one (1) year in the House of Correction, in addition to the civil penalties set forth in Section 177.
